We at Fiskars Group are committed to protecting the privacy of our customers and other visitors who use our websites. This Privacy Notice informs you how Fiskars Group (“we”) processes your personal information. For the purposes of this Privacy Notice, we are the controller. This Privacy Notice concerns .com website, products and services, which collect personal information or which are linked to this Privacy Notice or on which this Privacy Notice is visible. We have a shared consumer register, and our group companies act as joint controllers for that register.
In this Privacy Notice we explain the purpose of collecting and use of your personal information as well as how we have ensured that you have adequate control over your own personal information.
Our website may contain links to other websites or to integrated services. We are not responsible for the content of websites or services from other companies or their practices in connection with the processing of personal information. When you visit other websites, you are urged to read the owner's privacy policy as well as other relevant policies.
We recommend that you read this Privacy Notice carefully as it provides important information about the personal information that we collect. If you have a webstore account with us, please remember to update your information if any changes occur. Should you have any questions, requests or concerns, you can contact our Customer Service.
1. What data do we collect and how the data is collected
We may collect the following information from you:
- Contact details: your name, email address(es), telephone number, postal address;
- Information related to your orders: ordered products, payment method, payment card information, invoicing details, delivery method, delivery address, use of discount codes or benefits, selected services such as customization, engraving and other information related to any business you may do with us (returns, requests, reclamations, warranty claims etc.);
- Information you provide when you use our chatbot or contact our Customer Service;
- Information you insert to your webstore account;
- Gift purchase information: the recipient’s name, contact address, delivery address(es), telephone number, email address(es), your message to the gift recipient (if applicable) and engraving (if applicable);
- Any consents, communications and feedback that you provide to us;
· Survey and research answers provided by you. Survey/research interviews may also include subject to your approval, audio and video recordings, screen content and interactions, text input and device configurations;
- Demographic information (collected usually in connection with surveys and research or webstore account): gender, date of birth or age, language, title or degree, income information, accommodation information, household size;
- Personal interests and hobbies notified by you;
- Your entries to campaigns, events, workshops, contests or sweepstakes (this can be, for instance, comment on social media, an image or video or similar content);
- Information you provide when you register to participate in our events or workshops and during or after participation. This can also include allergies/dietary choices and other preferences you may provide us with;
- User-generated content provided by you. We can, for instance, comment on your post in social media and ask for your permission to use the content (e.g. an image) you have posted;
· Reviews you submit on gerbergear.com. Reviews can include information such as your nickname, product rating, your thoughts on the features, quality and experience with the product as well as images and videos you may attach to your review. You may receive emails regarding your review. Any emails will include the ability to opt-out of future communications;
- Work-related information provided by you: your company/employer’s name and contact details;
- Official identification, such as a copy of a passport or driver’s license, if we need to officially identify you; and
- Other information collected based on your prior consent (including public social media profiles).
Information created or collected when our website or interactive products or services are used:
- Information generated by us such as customer ID, statistics, analytics, profiles and similar;
- If you have a webstore account: your user account identity, one-time passcodes, registration date, purchase history, last viewed items, settings, log data;
- Information about your Pro Program membership;
- Benefits, discounts, campaigns and services directed or offered to you, and your use of them;
- Information related to the consents you have given and terms you have accepted;
- Longitude and latitude coordinates, for the purposes of displaying delivery address on a map on the order confirmation page;
- Information on whether you have opened a newsletter and clicked any of the content;
- Information collected by cookies, pixels, other identification tags or similar technologies. Depending on your cookie setting choices, this information can include data types such as:
o Name, email address, phone number, third party user ID and country;
o Your browser, operating system, device model, IP-address, time of access and duration of access;
o Websites through which our website was accessed, pages on our website browsed by you, all other actions with our website during your website visit (e.g. interactions, referral sites, key search words);
o Cookie profile
- Your contacts with Customer Service and communication with you, which may include phone recordings (you will be informed if a call is recorded); and
- Other information collected based on your consent or our legitimate interest
Information collected from other sources which can be combined with your customer information:
- If you have connected to any Fiskars Group website, service or social media channel using your social media profile(s), we may collect the public information available on your social media profile(s);
- Transaction details such as payment confirmation status from payment service provider;
- Information other customers provide about you e.g., for the purpose of sending you a gift;
- Updated delivery and contact information from delivery service providers;
- Information from third parties to complement the data collected by us, within the boundaries of applicable laws; and
- Information from public registers maintained by authorities, if such registers are available in your country, also for status verification purposes.
2. How do we use your personal information?
We collect your personal information to offer you our products and services. We also want to give you a smooth shopping experience and operate and maintain our websites and services effectively. In detail, we may process your personal information for the following purposes:
I. Product and services orders
If you have ordered products or services from our webstores, we process your personal information for the purposes of processing and fulfilling your order(s), but also for returns, warranty claims and reclamations, and to perform the service agreement(s) between you and us.
If you make purchases at our webstores, your personal information will be processed for payment processing purposes. Please note that details on payment methods, such as your full credit card number or similar, are not stored in our systems. Payment data is securely collected and processed by authorized third-party payment service providers. Payment service providers process all payment data whereas we collect information on selected payment methods and invoicing details.
We use Shopify Payments Services on our webstore. Shopify processes customer payment data to provide the Payments Services. Stripe, LLC is the payment processor who accepts and process payment transactions, and/or to settle funds from payment transactions, made by accepted payment methods. Stripe may also process personal information as a Business (determines the purposes and means of processing) for certain processing activities, including but not limited to complying with KYC (Know Your Customer)/AML (Anti-Money Laundering), sanctions, and other legal obligations, in which case Stripe’s Privacy Policy applies (see sections applicable to End Customer, section on Jurisdiction-specific provisions and U.S. Privacy Disclosures).
II. Offering and developing products and services, marketing and personalizing
We want to offer you the most interesting products and services and a customized shopping experience. Therefore, we may analyze, derive information or draw inferences from your interests, preferences, past purchases and reflections based on the information we collect and profiles we create based on your data. We may process your personal information to optimize our websites, to show product recommendations and product assortment to better meet your preferences. For this purpose, we can create a profile which is based on the data provided by you and data collected by us in accordance with this Privacy Notice. The profile can, for example, include data collected by cookies and similar tacking technologies (subject to your consent), information on your previous purchases, records of whether you have opened any emails we have sent you, and clicked on any content within those emails. Profiling does not include such automated decision-making which produces legal or similarly significant effects concerning you.
Your personal information may be processed for the purpose of informing you about our products and services, announcing any new product or service launches or benefits available to you, and concluding market surveys, provided that we have obtained consent, if required.
We may send you direct marketing e.g. by email or SMS or show you targeted digital advertisements, if you have given your consent for us to do so or if we have other legal basis, such as legitimate interest, for doing so.
We use advertising partners (e.g., Google and Social Media platforms) to show targeted digital advertising to you or others with similar profiles (lookalike audiences) on this and other websites or online services. These advertising partners can collect your data by cookies/similar technologies which are placed on our websites or by receiving your information (such as hashed name, email address and phone number) from us. Advertising partners use this data to target digital advertising to you or others with similar profiles. Please see our Cookie Notice for information on how to control cookies/similar technologies and prevent targeted digital advertising (please note that cookie settings are browser specific). To opt out from other than cookie-based targeted digital advertising, please submit this form.
Please note that even if you have not given consent to cookie-based targeted digital advertising or have chosen to opt out from targeted digital advertisement based on your other identifiers, you may still see advertising by different Fiskars Group brands around the Internet. Such advertising is not personalized based on your personal information that we have collected.
III. Pro Program
We use your personal information to verify your eligibility, managing the Pro Program, providing you with the benefits and services in effect from time to time in our Pro Program and if necessary, informing you of changes.
IV. Webstore account
A webstore account is created for you when you
1. register a webstore account;
2. place an order at the webstore;
3. join the Pro Program; or
4. subscribe to a newsletter.
Your account is linked to the email address you use when you register the account, place an order, join the Pro Program or subscribe to a newsletter.
Your webstore account includes your profile information such as name and contact details and your purchase history.
We process your data for the purpose of creating, maintaining and managing your webstore account and to inform you about changes regarding your account. We may process your personal information and account details to both improve our existing products and services, and to develop new ones.
V. Back in Stock and Coming Soon notifications
If you want to be notified about product availability, you can subscribe to an email notification on our website. Your email address will not be used for other purpose than sending the requested notifications.
VI. Chatbot and AI-Assisted Features
We use an automated chatbot to assist with product and purchasing questions. The chatbot provides automated responses and recommendations in real time.
It operates within defined parameters and can escalate to a human agent when needed. You may also ask to be connected with customer service.
The chatbot does not make decisions that have legal or similarly significant effects. Conversations are processed by Klaviyo, Inc. to generate responses. Customer data is not used to train large language models.
The chatbot will not provide answers to questions regarding your orders, account information or other personal information, unless you are signed in to your account.
Chatbot conversations are recorded and may be stored in your customer profile. If the chatbot conversation can be linked to you, the information you share is treated as personal information under this policy and subject to the same rights described in this State Privacy Notice.
Do not share payment card numbers, passwords, or other sensitive personal information in the chatbot.
Chatbot responses are automated and may not always be accurate or complete.
VII. Customer Service and product warranties
Our Customer Service team will process your personal information if you contact them. Your calls to the Customer Service team may be recorded, in which case you will be informed of such recording beforehand.
If you contact our Customer Service team by email or through chatbot, we will process the information you provide.
We may connect the personal information collected by the Customer Service team with other personal information, such as your purchase history, which enables us to provide you with as efficient and personal service as possible. We can process your data also for the purpose of ensuring that the service we provide is up to our standards.
Sometimes Customer Service may need to verify that you are really you – for that purpose, we may need to ask for further information or your official identification. Your personal information may also be processed for warranty-related activities, such as claims related to warranties.
VIII. Customer feedback, surveys and research
Product and service development is essential to us and enables us to provide our customers with ever better, more innovative and user-friendly products and services. We may connect any feedback and communication received from you with your account, including your responses to surveys or panels. The processing of personal information collected through such research, panels and surveys is governed by this Privacy Notice, unless otherwise stated in connection with the research or survey.
Such measures may include, for example:
- Surveys/research conducted via our websites: We may use questionnaire tools from time to time to improve our customer experience.
- Loyal customer community: To improve our services to meet our customers’ needs, we may provide you with surveys or research questions concerning our products and services (whether in hard copy or online).
- Research/surveys sent via email: We may, from time to time, send you surveys via email concerning our products and services, always subject to compliance with this Privacy Notice and the requirements of applicable law.
· Research interviews conducted online or offline: We may ask you to participate in a research interview, which may be recorded (audio and video recordings).
We use aggregated and/or anonymized data for reporting purposes. Such data has been aggregated and/or anonymized and cannot be used to identify you. We use such data to analyze the realization of our commercial objectives, such as effectiveness of our product campaigns.
IX. Workshops, events, campaigns, contests and sweepstakes
We may invite you to our contests and sweepstakes. If you participate in our contests or sweepstakes, the data you have provided will be processed for the purposes of organizing and administrating the contest or sweepstake, for communicating with you if you are the winner and for delivering a prize, if applicable. We may also use your data when organizing events, workshops and campaigns to process your registration, identify you, verify your participation, accommodate your dietary choices, and also afterwards, as we may need to process your data, for example, to send you the items you may have created in our workshops.
X. To process your request regarding use of data privacy rights
When you exercise your data privacy rights, we use your personal information to process your request and to reply to you. The processed information contains:
- your name and email address
- your request and related information
- the manner in which the request was submitted
- country, language, and relevant brand(s)
- our communication with you about the request
XI. Security and fraud prevention
We use your personal information for authentication purposes when you sign in to your account. Please keep your account credentials safe and do not share them with anyone else.
We use hCaptcha and Google reCAPTCHA for security, fraud prevention, and abuse prevention purposes. reCAPTCHA sets a necessary cookie (_GRECAPTCHA) when executed for the purpose of providing its risk analysis.
We process personal information, as necessary, to detect, investigate and prevent fraudulent, illegal or malicious activity to secure our websites and services and to protect customers’ personal information.
XII. Compliance with legal obligations and detection, investigation and prevention of unlawful activities
We process your personal information, as necessary, to comply with applicable laws. For instance, order and purchase data (including receipts) are processed to comply with our legal obligations (such as bookkeeping obligations).
We may use your data for investigating suspected unlawful activities. We may also provide your information to law enforcement authorities based on their request or based on a legal basis defined in any applicable law, for prevention and investigation of fraud and other unlawful activities.
We may disclose your personal information to any party in response to an order from a court of competent jurisdiction. We may also disclose your personal information to supervisory authorities (such as data protection supervisory authorities) based on a legal basis defined in any applicable law.
3. For how long is your personal information stored?
We will store your personal information if you have placed an order on the website, you have an active webstore account, you are a Pro Program member, you subscribe to our newsletter or contact our Customer Service. We will delete or anonymize your personal information if you have been inactive for 3 years (have not signed in to your webstore account, have not made any purchases, have not contacted us, have no open cases (such as request, return or reclamation) with us, and have not opened our newsletters)). You may also request us to delete your personal information by contacting our Customer Service.
Please note that we may not be able to delete all your personal information based on the above-mentioned criteria. If you have placed an order on our website or made a purchase at our stores, we must store the purchase data (including your personal information, as applicable) as long as required to comply with our legal obligations, such as bookkeeping obligations.
Deletion of personal information from backups and logs will happen in accordance with the backup and log specific retention times which may differ from the above-mentioned retention times.
Retention time of surveillance camera footage varies between locations and is defined based on the location specific needs.
If you use your data privacy rights, we will retain a record of your request and the related correspondence. Such information is maintained separately from other customer data, and access thereto is restricted. Requests and related information are retained for a period of three years for the purpose of demonstrating compliance with applicable data privacy obligations and managing any complaints or legal claims.
We may also retain your personal information for the duration of any period necessary to establish, exercise or defend any legal rights.
We can have specific data retention periods for campaigns, promotions, sweepstakes, events, surveys and research. If we have, for example, communicated that your data will be stored only for the duration of a campaign and a 60-day defined period thereafter, we apply this specific retention period.
4. In what situations is your personal information disclosed to other parties?
Depending on the context of processing, we disclose your personal information to the parties indicated below and for the following reasons:
· Affiliates and third-party vendors
We may disclose your personal information to Fiskars Group companies and authorized third-party vendors which process the data to perform contracted services for us. Such disclosures may include, but are not limited to, payment services providers, IT and cloud service providers, companies that facilitate your orders, delivery companies, customer service teams, and companies that analyze and manage consumer data for us, conduct credit checks, market research and marketing campaigns. These authorized third parties may use your data to perform contracted services. Where separately agreed, Shopify and other authorized third-party vendors may also use your anonymized data to analyze the usage of their services and to develop them.
· Platform provider
This website is hosted by Shopify. In addition to processing your personal information on our behalf in order to enable the processing of your orders, Shopify collects and processes personal information about your access to and use of the website in order to provide and improve the services for you.
Information you submit to the website will be transmitted to and shared with Shopify as well as authorized third parties that may be located in countries other than where you reside, in order to provide and improve the services for you, to carry out transaction processing and for fraud prevention purposes.
In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our website, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our website, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including responding to your requests to exercise your rights over use of your personal information for these purposes.

Depending on where you live, you may exercise certain rights with respect to your personal information in Shopify Privacy Portal.
· Targeted digital marketing
We use advertising services provided by Meta Platforms Ireland Limited (“Meta”) and Google Ireland Limited (“Google”) to deliver relevant advertisements to you and to measure the performance of our advertising campaigns.
Meta
For advertisements displayed via Meta’s platforms, we and Meta act as joint controllers of certain personal information.
Under the joint controllership arrangement, we determine the target audience for our advertisements (such as age range, interests, and location), while Meta operates the advertising platform and matches advertisements to users based on information they hold about them.
We process your personal information for targeted advertising based on our legitimate interests in promoting our products. The processed personal information includes demographic information (such as age, gender, general location), your interests and online activity, and technical information about your device.
You can exercise your rights under Articles 15-21 of the GDPR (including access, erasure, and objection to processing) by contacting either us or Meta. Please note, however, that Meta is responsible for enabling your rights with regard to the personal information stored by Meta.

When we use Google’s advertising services, we and Google act as independent controllers of personal information.
Google processes personal information for its own purposes as described in Google’s privacy policies, including improving its advertising products, ensuring the security and functioning of its systems, and providing personalized or non‑personalized ads where applicable.

Shopify
We also use advertising services provided by Shopify International Limited (Shopify). Shopify acts as an independent controller of personal information for these services. If you consent to targeting cookies, you may see ads based on your activity in our store, with other merchants, and with Shopify.

· Embedded third-party services
Our websites can include third-party services, such as Google Maps functionality on the order confirmation page to display the delivery destination. For map rendering, the city, province, country, and latitude/longitude coordinates are shared with Google. This data which is shared with Google is not tied to specific personal identifiers.
Use of Google Maps features, and content is subject to the Google Maps Terms of Service at https://maps.google.com/help/terms_maps.html and Google Privacy Policy at https://www.google.com/policies/privacy/.
· Requests based on legislation and protection of our interests
We may be required to disclose your personal information to authorities or third parties by the binding requirements of applicable law or in response to an order from a court of competent jurisdiction, or for the purpose of responding to legal proceedings or other lawful requests. We may also disclose or otherwise process your personal information, in accordance with applicable law, to defend our legitimate interests (for example, in civil or criminal legal proceedings) and when combating fraud.
· Mergers and acquisitions
In the event of any sale, consolidation or reorganization of our businesses (for example mergers and acquisitions), we may disclose your personal information to prospective or actual purchasers or their advisers, with adequate protection, where appropriate.
5. On what legal basis do we process your personal information?
Requirements regarding legal bases of processing vary between countries and continents. We collect your personal information based on one or more of the following legal bases:
1. we have obtained your consent (written, verbal or online) to the processing of your personal information – You have a right to withdraw your consent to the processing of your personal information, at any time, by contacting Customer Service team;
2. the processing is necessary in connection with any contract between Fiskars and you – for example, if you have purchased products from us, registered to a loyalty program, have given your permission for us to use content generated by you, or similar;
3. we have a legitimate interest in carrying out the processing for the purpose of managing, operating or promoting our business, displaying digital advertising or protecting of property and preventing crime; and that legitimate interest is not overridden by your interests, fundamental rights or freedoms; or
4. we have a legal obligation to process your personal information.
6. Do we process the personal information of children?
We do not seek to collect personal information of children. Children may occasionally be recorded on our camera surveillance footage if they visit or are nearby our premises. Children may also participate in some of our events, workshops, photoshoots or interviews subject to approval of their legal guardian.
Product orders will only be accepted by us if you are 18 years old or older.
We do not knowingly collect personal data from children under the age of 13. If we become aware that a child under 13 has provided personal data without verifiable parental consent, we will delete that information promptly.
7. International data transfers
Our services are provided using resources, vendors and servers located in various countries, also outside of the U.S. Therefore, your personal information will be transferred across international borders outside the country in which you use our services. personal information
8. How do we protect your personal information?
We have implemented a variety of appropriate technical and organizational security measures to protect your personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or unauthorized access, and other unlawful or unauthorized forms of processing. The safeguards include, for example, firewall protection of our systems and storing physical documents in locked and fireproof premises. Further, the databases and their backup copies can be accessed only by certain pre-designated persons; all persons processing personal information will need to have an individual accreditation; only specifically authorized personnel of ours or authorized third parties are entitled to access our premises or process data; and anyone who is granted access to your personal information is required to keep such data confidential. Different levels of access have been created based on the type of data a person needs to access or process according to his/her job description. However, no security measures are 100% effective, and if you are concerned about the security of your information, you do not have to submit your information to us. Please note that we may then be unable to provide you with certain services.
9. What are your rights and how you can use them?
Below, we set out the data privacy rights available to you and explain how you may exercise those rights in relation to us.
If you wish to exercise your data privacy rights in relation to Shopify, you may do so using the mechanisms made available through the Shopify Privacy Portal.
You may choose not to provide your personal information to us
Some features of our websites and other services may not be fully available to you if you choose not to give us your personal information (e.g. we may not be able to process your orders without the necessary details).
You may access your data
You may request access to, or copies of, your personal information by contacting our Customer Service. You may also have information regarding the nature, processing and disclosure of your data.
You may unsubscribe from direct marketing
We include an unsubscribe link in all electronic marketing messages we send to you. You may also withdraw your marketing consent by contacting our Customer Service. You may withdraw your consent to direct marketing at any time. If you do so, we will update our databases, and will not send you further direct marketing, but we may continue to contact you to the extent necessary for the purposes of any products or services you have requested.
You may check and edit your personal information
To help keep the personal information we process accurate and up to date, we encourage you to update your information whenever your information changes.
If you have a webstore account, you may edit your personal information directly yourself. If not, you may contact our Customer Service, who will, upon your request and as soon as possible, correct, remove or complete the information which is incorrect, unnecessary, lacking or outdated.
You may block and delete cookies
You have the right to choose which cookies you accept and amend your choice afterwards. Please visit our Cookie Notice to read more.
You may request the erasure or restriction of processing your data
Should you believe that your personal information is inaccurate, the processing of it is illegal, we are not processing your data in accordance with the processing purpose, or you want to oppose the processing, you may contact our Customer Service team to request erasure of your data or restrictions on the processing of your data. Please note that we will investigate your request reasonably promptly, before deciding what action to take.
You may object to the processing of your data
You may have the right to object, on legitimate grounds, to the processing of your personal information. You can object to the processing of your personal information, at any time, by contacting Customer Service team. To object to digital marketing, please fill in the digital marketing opt out form.
You may withdraw your consent
You may at any time withdraw your consent to the processing of your personal information. If your consent is withdrawn, it does not prevent us from processing your personal information based on other lawful bases, such as for requirements set forth for us under applicable laws. The withdrawal of consent does not affect the lawfulness of any processing performed prior to the withdrawal.
You have a right to withdraw your consent for processing your personal information, at any time, by contacting our Customer Service.
You may have your data transferred to another provider
You may have the right to data portability, which means you can have your personal information transferred to another controller in a structured, commonly used and machine-readable format, to the extent applicable. You may contact our Customer Service if you wish to request your data to be transferred.
You may lodge a complaint with the supervisory authority
Should you believe that our processing of your personal information infringes your legal rights, you may lodge a complaint with your local supervisory authority.
Please note that upon exercising any of the rights listed above, you may be requested to provide additional information for identification purposes. Such additional information shall not be used for any other purpose.
10. Gerber Outdoor, LLC State Privacy Notice at Collection and Privacy Rights
Certain states, including California, Virginia, Colorado, Connecticut, Texas, Florida, Montana, Oregon, Iowa, Tennessee, Indiana, Delaware, New Hampshire, Nebraska, New Jersey, and other states that have enacted comprehensive consumer privacy laws. Depending on whether you are a resident of those states (“Consumer”), we provide you additional notices about our privacy practices and consumer privacy rights relating to your personal information or personal data, as defined under those laws (“Personal Information”).
Fiskars Group and its affiliates and subsidiaries, including Gerber Outdoor, LLC (“Fiskars,” “we,” “us,” or “our”) provide this State Specific Privacy Notice (the “State Privacy Notice”) to supplement the information contained in the Consumer Privacy Notice. Where we specifically identify certain states, these additional disclosures apply to residents in those states.

The California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”) and comprehensive privacy laws in Virginia, Colorado, Connecticut, Texas, Florida, Montana, Oregon, Iowa, Tennessee, Indiana, Delaware, New Hampshire, Nebraska, New Jersey, and other states (collectively, "Applicable State Privacy Laws") afford consumers residing in those states certain rights with respect to their Personal Information. If you are a California resident, including a business contact of one of our vendors or other type of business which transacts with Fiskars (collectively, “CA Business Contact”), or a Virginia resident, this section applies to you.

Fiskars offers a wide variety of products through our iconic brands (each a “Brand”). We may collect Personal Information from you in a variety of different situations, including, but not limited to our websites, your mobile device, through email, in physical locations, through the mail, over the telephone, and/or in any other situation where we interact with you, including through our Brands. More specifically, Fiskars collects the following categories of Personal Information from its Consumers, which will depend on the particular Business Purpose for which we collect it:

Personal Information does not include deidentified information or aggregate consumer information.
Fiskars obtains the categories of Personal Information listed above from the following categories of sources:
- Directly from you. For example, from forms you complete or products and services you purchase, or when you communicate with us about our ongoing business relationship.
- Indirectly from you. For example, from observing your actions on our website or from information your computer or mobile device transmits when interacting with our website or mobile applications, among other things.
How We Use Personal Information
We may use or disclose the Personal Information we collect from you or about you for the following business purposes:
- To fulfill or meet the purpose for which you provided the information. For example, if you disclose your name and contact information to ask us a question or inquire about our products or services, we will use that Personal Information to respond to your inquiry. When you sign up to receive information about products, services, or other benefits from us, we may use your information to facilitate communication about that product or service. If we seek to or do engage you as a vendor or other type of business relationship, we use your Personal Information to communicate about our potential, current, or former business relationship.
- To contact you and to inform you about products, services, promotions, special offers, and/or events that may interest you.
- To provide you information about our products and services.
- To provide, support, personalize, and develop our websites, products, and services.
- To create, maintain, customize, and secure your account with us.
- To process your requests, purchases, transactions and payments, and prevent transactional fraud.
- To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
- To personalize your website experiences and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our websites, third-party sites, and via email or text message (with your consent, where required by law).
- To help maintain the safety, security, and integrity of our websites, products and services, databases and other technology assets, and business.
- For research, analysis, and business development, including to develop and improve our websites, products, and services.
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
- As described to you when collecting your Personal Information or as otherwise set forth in the CCPA or other applicable laws or subsequently agreed to by you.
- To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Fiskars' assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Fiskars about our Consumers is among the assets transferred.

Sales of Personal Information
California law provides for certain disclosures about Personal Information we “sell,” which means certain scenarios in which Fiskars has disclosed Personal Information with third parties or affiliates, in exchange for valuable consideration. In the preceding twelve (12) months, Fiskars has not sold Personal Information.
Notice of Financial Incentive
California’s privacy law requires that we notify you if we provide you a program, benefit, or other offering, related to the collection, deletion, or sale of Personal Information, which it defines as a “financial incentive.” We offer discounts, coupons, or other product incentives to prospective and current Fiskars Brand consumers, including our My Wedgwood, Waterford.com member program and Royal Copenhagen Collector’s Club. Sometimes, consumers sign up or provide us their Personal Information (e.g., email address, names phone numbers) in order to receive our discounts, coupons, warranties, or other product incentives. As such, under the CCPA, our discounts, coupons and product incentives may be considered financial incentives provided in exchange for the collection and retention of Personal Information.
We offer these discounts, coupons and other product incentives to enhance our relationship with you or so you can enjoy or try our products at a lower price. There is no obligation to opt-in and consumers may opt-out at any time. The details of each program are contained in each program offering.
The consumer data received in exchange for your participation is dependent on a number of factors, including, for example, whether and to what extent you take advantage of any offerings and whether and to what extent you opt out of any offerings but is roughly equivalent to the value of the coupon or product offered.
Retention of Personal Information
We retain your Personal Information for as long as necessary to fulfill the purposes for which it was collected, as described in this notice, and to comply with our legal obligations. The criteria we use to determine retention periods include: the duration of our ongoing relationship with you; whether we are subject to a legal obligation to retain the data; and whether retention is necessary to resolve disputes, enforce agreements, or protect our legal interests.
Information Relevant to California and Other States
Targeted Advertising and California Sharing of Personal Information
The CPRA requires that we notify you if we “Share” your Personal Information with third parties. For purposes of the CPRA, “Sharing” means that we make available or otherwise disclose your information to third parties for cross-context behavioral advertising, such as targeting of advertising to you based on your Personal Information obtained from your activity across businesses, websites, apps, and services other than our Services.
Similarly, the VCDPA requires that we notify you if we use your information for Targeted Advertising. Targeted Advertising means displaying advertisements to you where the advertisement is selected based on Personal Information obtained from your activities over time and across nonaffiliated websites or online applications to predict your preferences or interests
Accordingly, we “Share” and use your information for Targeted Advertising. Specifically, we disclose your identifiers and internet or other network activity with Service Providers and third parties with whom you direct us to disclose your Personal Information. Sensitive Personal Information
Privacy laws in California and Virginia specify certain rights with respect to our collection of certain information those laws designate as “Sensitive Personal Information.” We obtain consent to collect that information in those states where consent is required. Moreover, each state’s privacy laws may consider different pieces of information to be “Sensitive Personal Information.” When we notify residents of certain states that we collect Sensitive Personal Information, that means that we collect Sensitive Personal Information within the meaning of the law of that particular state. We collect Sensitive Personal Information in California and Virginia. We collect the following types of Sensitive Personal Information, to the extent included in your state’s definition: Financial account, debit card, or credit card number in combination with any required security or access code, or credentials allowing access to an account; precise geolocation.
Global Privacy Control
You can also opt out of certain sharing and sales by visiting our Services with a recognized universal choice signal enabled (such as the Global Privacy Control). Please note that, depending on which opt-out preference signal you use and whether you are logged into your account with us, our processing of the signal may be limited to the specific browser or device that you are using]. You may need to renew your opt-out if you use a different browser or device to access our Services.
Your Consumer Rights and Choice
Subject to certain limitations and depending on your state of residence, you may have the following rights with respect to your Personal Information: (1) request to know more about the categories and specific pieces of Personal Information we collect, use, disclose, and sell, and to access your information, (2) request deletion of your Personal Information, (3) request correction of your Personal Information and (4) opt out of the sale of your Personal Information, the sharing of your Personal Information for cross-context behavioral advertising, and the use of your Personal Information for Targeted Advertising; , (5) limit processing of Sensitive Personal Information;(6) opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you; and (7) not be discriminated against for exercising any of these rights. Fiskars will not deny you goods or services, charge you different prices, or provide a different quality of goods or services because you exercised a right under an Applicable State Privacy Law.
Access to Specific Information and Data Portability Rights
You have the right to request that Fiskars disclose certain information to you about our collection and use of your Personal Information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request (see Exercising Your Privacy Rights), we will disclose to you:
- The categories of Personal Information we collected about you.
- The categories of sources for the Personal Information we collected about you.
- Our business or commercial purpose for collecting that Personal Information.
- The categories of third parties with whom we disclose that Personal Information.
- The specific pieces of Personal Information we collected about you.
- If we disclosed your Personal Information for a business purpose, a list identifying the Personal Information categories that each category of recipient obtained.
Deletion Request Rights
You have the right to request that Fiskars delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.
We may deny your deletion request under certain circumstances, and will inform you of the basis for the denial, which may include, but is not limited to, if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.
Right to Limit Processing of Sensitive Personal Information
In California, you have the right to limit our processing of Sensitive Personal Information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests such goods or services. When we collect your Sensitive Personal Information, we collect and use that information in order to perform the services or provide the goods for which that information is necessary and as reasonably expected by you. Moreover, we do not use your Sensitive Personal Information for the purpose of inferring any characteristics about you. We will notify you if we use your Sensitive Personal Information for purposes you might not reasonably expect so that you can request that we limit that processing. Where your state’s privacy law requires that we obtain consent or provide an opt-out in order to collect or process Sensitive Personal Information, we do so.
Right to Correction
You have the right to correct inaccurate Personal Information maintained by us. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights), we will correct (and direct our service providers to correct) your inaccurate Personal Information from our records, unless an exception applies.
Right to Opt Out of Profiling
Residents of certain states, including Colorado, Connecticut, Oregon, and Texas, have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. We may use automated processing to develop inferences about your preferences or interests for purposes such as product recommendations and targeted advertising. To opt out of profiling, please submit a request by contacting Customer Service.
Exercising Your Privacy Rights
To exercise the access, data portability, correction, and deletion rights described above, as well as to request that we limit our processing of your sensitive personal information, please submit a verifiable consumer request to us by contacting Customer Service.
Only you or a person authorized to act on your behalf may make a verifiable consumer request related to your Personal Information.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
If we deny your request, residents of California, Virginia, Colorado, Connecticut, Texas, and other states whose Applicable State Privacy Laws provide an appeal right may appeal our decision by contacting us at weborders@gerbergear.com. Please clearly denote that it is an appeal and identify the original request being appealed. We will respond to your appeal within the timeframe required by your state's law. If your appeal is denied, we will provide you with information about how to contact your state's attorney general or relevant regulatory authority.
Response Timing and Format
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing.
We will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Changes to Our State-Specific Privacy Notice
We may change this privacy notice from time to time. If we make changes to this privacy notice, we will notify you by revising the Effective Date at the top of this policy and, in some cases, we may provide you with additional notice, such as adding a statement of notice on the websites or sending you a notification. We encourage you to review this policy regularly to stay informed about our information practices and the choices available to you.
