TERMS OF SALE – Gerber Gear

1. GENERAL
These Terms of Sale apply to all purchases made through the online store at www.gerbergear.com (the "Site"), operated by Gerber Outdoor, LLC ("Gerber," "we," "us," or "our").
These Terms of Sale govern the purchase relationship between you and Gerber. Your access to and use of the Site is separately governed by our Terms of Use, which are incorporated herein by reference. By placing an order through the Site, you confirm that you have read and agree to these Terms of Sale, our Terms of Use, our State Privacy Notice, and any additional terms applicable to specific promotions, products, or services.
If you have questions about a purchase, please contact our Customer Service team. Please have your order number available when contacting us about a specific purchase. We handle inquiries relating to purchases made through our Site only. For products purchased through a third-party retailer or physical store, please contact that retailer directly.
Any notices, disclosures, agreements, and other communications relating to your use of the Site will be provided to you electronically.
These Terms of Sale do not affect your statutory rights, which cannot be waived or limited by contract.
2. ORDERS
By placing an order through the Site, you confirm that you are at least 18 years old and legally capable of entering into a binding contract. You must provide your full name, accurate shipping and billing addresses, phone number, email address, valid payment information, and any other information required to complete your order.
Our ordering process allows you to review and correct your order before submission. Once submitted, your order cannot be modified, including adding or removing items.
When you submit an order, you will receive an order acknowledgment by email. This acknowledgment is not an acceptance of your order and does not constitute confirmation of our offer to sell. Order acceptance and the formation of a contract between you and Gerber occurs when the ordered products are dispatched from our warehouse and you receive a shipping confirmation email.
3. ORDER ACCEPTANCE
We reserve the right to accept or decline any order at any time prior to shipment, for any or no reason, including product unavailability, pricing errors, or suspected fraudulent activity. We may also supply fewer units than ordered without prior notice. We may need to verify information you provide before accepting or processing your order. If we cannot accept your order, we will notify you and will not charge you, or will promptly refund any amount already charged.
We reserve the right to limit the quantity of items purchased per person, per household, or per order. These restrictions may apply to orders placed by the same account, the same payment method, or the same billing or shipping address. We reserve the right to prohibit sales to dealers or resellers. For purposes of these Terms of Sale, reselling means purchasing or intending to purchase any product from us for the purpose of engaging in a commercial sale of that product to a third party.
4. CUSTOM PRODUCTS
Gerber custom creations take 12-15 business days to ship from the date of order acknowledgment.
Once custom order is placed, the text and design are final and changes cannot be made. Please double-check for accuracy before confirming. We are not responsible for errors in submitted text or design confirmed at checkout.
Our designers reserve the right to make layout adjustments, including splitting text onto multiple lines, resizing, or adjusting placement and orientation, as necessary to fit your message within the engraving area.
Engraving messages or designs which contain profanity, insults, sexual content, hate speech, or trademarks will not be fulfilled. Customer is responsible for any third-party claims arising from submitted content.
Customization is permanent and may affect the surface finish or coating of the product. Engraved products may not perform identically to non-engraved versions.
Custom products may not be returned or cancelled.
5. PRICING, ERRORS, AND CORRECTIONS
All prices on the Site are in U.S. dollars. Prices are subject to change without notice, but the price at the time your order is accepted is the price that applies. Price changes will not be applied retroactively to accepted orders. Prices on the Site may differ from prices at physical retail locations or third-party retailers.
Despite our best efforts, typographical or pricing errors may occur. If a product is listed at an incorrect price, Gerber reserves the right to: (a) refuse or cancel any order placed at the incorrect price, whether or not the order has been confirmed; and/or (b) contact you to discuss the error before processing or shipping. If Gerber cancels an order due to a pricing error, we will issue a full refund of any amount charged.
Pictures displayed on the Site are for illustration purposes only. Colors displayed may vary from the actual product depending on your monitor and display settings. Gerber is not responsible for such color variations.
6. PAYMENT METHODS AND PAYMENT PROCESSING
We accept only certain payment methods, which will be indicated when you proceed to payment. You can find more detailed information about payment options here.
You will be required to provide the billing address and telephone number on file with your card issuer and, where applicable, your card's security code. Incorrect information may delay processing. Your billing address must be within the United States.
Upon placing your order, we will require your card issuer or other payment service provider to place a funds provision on your chosen payment method. Your payment method will be finally charged when your order is dispatched. We will not ship your order until your payment method has been authorized. We reserve the right to cancel your order without prior notice if your chosen payment method cannot be charged.
By providing payment information, you expressly authorize Gerber, its agents, and processors to charge your selected payment method for your order. Gerber protects your payment information using SSL encryption.
Gerber uses Shopify Payments Services on this Site. Shopify processes customer payment data to provide the Payments Services. Stripe, LLC is the payment processor who accepts and process payment transactions, and/or to settle funds from payment transactions, made by accepted payment methods.
7. PROMOTIONAL CODES
Promotional codes are valid only on the Site unless otherwise stated and are subject to any specific terms communicated at the time of issuance. Promotional codes cannot be combined with other offers, discounts, or promotions unless explicitly stated. We reserve the right to withdraw or cancel a promotion at any time. If an order is returned, we reserve the right not to reinstate the promotional code.
Personally issued promotional codes are non-transferable. Codes distributed or shared without our prior written approval are invalid and may be rejected or canceled.
8. TAXES
Where required by applicable law, Gerber will collect and remit applicable state and local sales taxes on purchases. Applicable taxes will be calculated and disclosed at checkout before you complete your order. You remain responsible for payment of all taxes applicable to your purchase.
9. SHIPPING
Gerber ships to U.S. addresses in the 50 States and the District of Columbia. We do not ship to Puerto Rico, Guam, the U.S. Virgin Islands or P.O. Box addresses.
Shipping and handling charges are in addition to product cost and will be calculated and disclosed at checkout before you complete your order. Gerber reserves the right to impose a surcharge for certain large or heavy items, as noted on applicable product pages.
Your order will be shipped to the delivery address provided during checkout. Changes to the delivery address cannot be made once the order has been placed.
Orders are shipped as quickly as possible, subject to product availability. If a product is out of stock or unavailable, we will contact you to discuss next steps. We cannot guarantee specific delivery dates. During high-volume periods, longer delivery times should be expected. If your order includes multiple products, items may be shipped in separate shipments at no additional charge.
Risk of loss and title for products pass to you upon delivery to the carrier. Please inspect your order upon receipt. If any product is damaged or your delivery is incomplete, please contact our Customer Service team promptly.
We cannot be held responsible for delay or failure to deliver caused by circumstances beyond our reasonable control. We will take all reasonable steps to minimize any such delay. If for any reason we cannot deliver your order within thirty (30) days of your placing it, we will inform you as soon as possible and you will be entitled to a full refund to the original payment method.

10. RETURNS AND REFUNDS
You may return eligible products within 30 days of the date of purchase for a refund or exchange, provided the merchandise is in new condition and unused.
Gerber accepts returns only for products purchased directly through our Site. We do not accept returns for products purchased through third-party retailers, physical stores, or other online platforms. Personalized or custom-engraved products are not eligible for return.
Refunds will be processed to the original payment method used for the purchase, promptly after we receive and inspect the returned product.

For issues such as defects, missing items, or delivery problems, please contact our Customer Service team. You may be required to provide photographic documentation of alleged defects along with your order number. Please retain the product until your claim has been fully processed. In some cases, we may ask you to return the product for further inspection, in which case we will cover your reasonable return shipping costs for legitimate complaints.
11. PRODUCT DESCRIPTIONS AND AVAILABILITY
Gerber attempts to ensure that product information on the Site is accurate and current. However, we do not warrant that product descriptions, availability, or other content is accurate, complete, reliable, or error-free. Product availability and specifications are subject to change without notice.
12. PRODUCT WARRANTY
Any express written warranty applicable to a product will be provided with or described on the applicable product page. For complete details, please see our Warranty page.
13. PRODUCT-SPECIFIC PURCHASE RESTRICTIONS
Certain products sold on the Site, including automatic knives and other regulated tools, are subject to federal, state, and local laws restricting their purchase, possession, or use. By purchasing any such product, you represent and warrant that (a) you are legally permitted to purchase, receive, and possess the product in your jurisdiction, and (b) you have read and agreed to any additional product-specific terms or acknowledgments presented at checkout. Gerber does not ship restricted products to jurisdictions where their sale or delivery is prohibited by law.
14. OUR RIGHT TO CANCEL
We reserve the right to cancel your order if: (a) we do not receive or are unable to process your payment; (b) you provide inaccurate or fraudulent information; (c) a product is unavailable or mispriced; or (d) we are otherwise unable to fulfill the order. If we cancel your order, we will notify you and will not charge you or will promptly refund any amount already charged.
15. WEBSTORE ACCOUNT
When you place an order on the Site, an account may be created for you linked to the email address you use when placing the order. All orders placed using the same email address will be registered and accessible to you in that account. Please contact Customer Service to delete your user data & account information, including order history and billing.
16. PERSONAL DATA
Personal information collected in connection with your purchase is governed by our State Privacy Notice, which is incorporated herein by reference. Please note that the information you submit to the Site will be transmitted to and shared with authorized third parties that may be located in other countries than where you reside, in order to provide the services.
17. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GERBER'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR IN CONNECTION WITH YOUR PURCHASE OR THESE TERMS OF SALE WILL NOT EXCEED THE AMOUNT YOU PAID GERBER FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM. THIS LIMITATION DOES NOT APPLY TO ANY EXPRESS, WRITTEN PRODUCT WARRANTY PROVIDED BY GERBER OR A MANUFACTURER.
IN NO EVENT SHALL GERBER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR PURCHASE OR YOUR USE OF PRODUCTS OBTAINED FROM GERBER, EVEN IF GERBER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Certain state laws do not allow limitation or exclusion of certain damages. If those laws apply, some or all of the above limitations may not apply to you.
18. INDEMNITY
You agree to indemnify, defend, and hold harmless Gerber Outdoor LLC and its affiliates and their respective officers, directors, employees, and agents from and against any and all claims, liability, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your purchase, your use of products obtained from Gerber, or your violation of these Terms of Sale.
19. DISPUTE RESOLUTION AND GOVERNING LAW
Any dispute arising out of or relating to these Terms of Sale or any purchase through the Sites is subject to the dispute resolution provisions in our Terms of Use.
20. MODIFICATIONS
Gerber reserves the right to modify these Terms of Sale at any time. Changes will be posted to the Site with a revised effective date. The Terms of Sale in effect at the time your order is placed will govern your purchase.
If any provision of these Terms of Sale is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the largest extent permitted by applicable law. This shall not affect the validity, legality, or enforceability of the remaining provisions.
